MINUTES OF THE ANNUAL MEETING - 1997

The annual meeting of the Jericho-Underhill Water District was held in the United Church of Underhill in Underhill Flats on Monday, November 3, 1997. The moderator, William Frank, called the meeting to order at 7:02 p.m. by the reading of the Warning.

Action on Article #1.

William Frank was nominated to serve as Moderator for one year. The motion was seconded and so voted.

Action on Article #2.

A motion was made and seconded to accept the reports of the officers. Reports reviewed were the Minutes of the 1996 Annual Meeting, the Board of Trustees Report, the Report of the Treasurer, and the Auditor's Report. A motion to accept the reports as presented was unanimously carried.

Action on Article #3.

Katharine Koniuto was nominated for Clerk for one year. Nominations were voted closed and Katharine Koniuto was voted unanimously to be Clerk for one year.

Action on Article #4.

Peter Mitchell was nominated for Assistant Clerk for one year. It was so voted and the clerk was instructed to cast one ballot for Peter Mitchell for Assistant Clerk for one year.

Action on Article #5.

Katharine Koniuto was nominated for Treasurer for one year. Nominations were voted closed and Katharine Koniuto was voted unanimously to be Treasurer for one year.

Action on Article #6.

The names of 1997 auditors David Damkot, William Frank, and Douglas Keith were nominated to serve as District Auditors for another year. The slate of names was seconded and so voted.

Action on Article #7.

Marc Maheux was nominated to serve as collector of delinquent water bills. It was so voted and the clerk was instructed to cast one ballot for Marc Maheux for collector of delinquent water bills for one year.

Action on Article #8.

Harold Sargent was nominated for a three year term as President. It was so voted and the clerk was instructed to cast one ballot for Harold Sargent as President for a term of three years.

Action on Article #9.

Kenneth Crimmins was nominated for a period of one year to fill an unexpired term. It was so voted and the clerk was instructed to cast one ballot for Kenneth Crimmins as Trustee for one year.

Action on Article #10.

A motion was made and seconded to pay the clerk $125 per month for the services rendered by the Clerk. Following a discussion the motion was amended to pay the clerk $150.00 and seconded. The amendment was so voted and carried unanimously. The amended motion was so voted and carried unanimously.

Action on Article #11.

A motion was made to pay the treasurer $150 per month for the duties of District Treasurer. This motion was seconded and so voted.

Action on Article #12.

A motion was made and seconded to pay the President of the Trustees $500 and the Trustees each $250 per year to cover their expenses. It was seconded. The motion was amended to pay the President of the Trustees $500 and the Trustees each $200 per year to cover expenses and seconded. The amendment was so voted and carried by a vote of 3-2. The amended motion was then so voted and carried unanimously.

Action on Article #13.

A motion was made to exempt the Jericho-Underhill Library District from paying the connection fee required for water service provided the library assumes all other costs associated with the connection. The motion was seconded and so voted.

Action on Article #14.

A motion was made to exempt the Underhill-Jericho Fire Department from paying the connection fee required for water service provided the fire department assumes all other costs associated with the connection. The motion was seconded and so voted.

Action on Article #15.

A motion was made and seconded to adopt the proposed changes to the Jericho-Underhill Water District Regulations regarding Sections 11. Cross Connections; 12. FluctuationS of Pressures; 14. Service Line Trench; 15. Winter Construction; 17. Billing Procedures; 23. Fire Hydrants; 25. Water Main Extension, Plan, Approval and Construction; 26.b. Materials, Service Lines; 27. Water Rates and Charges; 28.a.(2) Cc (3). Connection Fees, Residential, Existing Building With Two Living Units, Three Living Units, and Four Living Units; 28.b.(3) Residential and Business Units. The motion was amended to change Section 17 to read:

Bills will be issued quarterly based on the calendar year, the amounts of which will be in accordance with rates shown in Section 27. Said bills are due immediately and will be in arrears if unpaid 30 days following receipt by the customer. Interest will be charged to all bills in arrears at the rate of one percent per month or fraction thereof, for the first three months, and thereafter one and one-half percent per month or fraction thereof from the date such bill is in arrears. Such interest shall be imposed on a fraction of a month as if it were an entire month. Bills in arrears shall be due and payable in accordance with procedures set forth in 24 V.S.A. Chapter 129. A charge of $15.00 will be assessed for a check returned by a bank.

The amendment was so voted and carried unanimously. The amended motion was then voted and carried unanimously.

Action on Article #16.

No other business was brought before the annual meeting.

Action on Article #17.

A motion was made and seconded to adjourn the annual meeting at 8:04 p.m. The motion was so voted.
